To depose a Connecticut resident for use in a foreign court, you may file an application under the
Connecticut Interstate Depositions and Discovery Act, authorized under § 52-655 through § 52-660 of
the Connecticut General Statutes (“C.G.S.”).
The application must be initiated electronically (unless initiated by a self-represented party or an e-filing
exempt attorney), using either the M75 Foreign Subpoena- Civil case or F75 Foreign Subpoena- Family
case type. Connecticut counsel is required to bring the action on behalf of any non self-represented
party, in accordance with C.G.S. § 51-88 and Connecticut Practice Book § 2-44A.
The following must be filed with the court:
- Application for Issuance of Foreign Subpoena (JD-CL-166).

Foreign Subpoena- Civil/Housing/Small Claims/Family (

), with the original or true copy
of the foreign subpoena.

If filed on paper, an Appearance (JD-CL-012).

Filing fee (collected electronically if the case is electronically filed).

Identify the Judicial District or Housing Session where the application is being filed

Docket Number- leave blank (to be used by the clerk).

Name(s) of Applicant(s)- provide the name of all parties seeking the subpoena, use additional
applicant(s) line if necessary.

Identify the type of court case for which you are seeking the subpoena.

Name of subpoenaed party: the name of the “person” (as defined by C.G.S. § 52-656(3)) the
subpoena is being sought for.
- Answer the questions regarding the subpoena being sought.

Provide the name and address of the person or entity for which the subpoena is being sought.

The applicant, or the applicant's Connecticut licensed attorney, signs the application.
Foreign Subpoena-Civil/Housing/Small Claims/Family Instructions

Name of case (full name of first named applicant and full name of subpoenaed party as
identified on the Application for Issuance of Subpoena).

Docket Number- leave blank (to be used by the clerk).
- Identify the Judicial District or Housing Session where the matter is being filed.
- Identify whether the application is being filed in a Judicial District or Housing Session.
- Provide the address of the Connecticut court in which the application is being filed.

In the “To: (Name and Address)” section, provide the name and address of the subpoenaed
person or entity.

Provide the date and time for compliance with the subpoena (must be within 60 days of
issuance).

Affidavit- Affiant must be a party (“applicant”) to the case (C.G.S. § 52-657(c)(2)), or the
applicant’s Connecticut licensed attorney. The affidavit may not be signed by foreign counsel.
Provide the information for the originating case that is pending in the foreign court (outside of
Connecticut).
