Judicial Ensures Continued Capias Service in New London County

NEW LONDONThe Connecticut Judicial Branch has taken the necessary steps to ensure that capiases are continuing to be served on New London area individuals who have failed to appear in court regarding their child support payments, notwithstanding the recent disbanding of the New London County Sheriffs’ capias unit.

A capias is issued by the court to command a sheriff or other authorized individual to take into custody an individual in violation of an order to appear in court for reasons such as delinquent child support payments.

The Judicial Branch recently sent letters to all eligible New London County Sheriffs individually informing them of the opportunities available to them to serve the capiases in the New London Judicial District. The Judicial Branch is forwarding capiases to sheriffs individually – a practice similar to what is already done in the other 12 judicial districts throughout the state.

In addition, a constable is legally authorized to serve a capias under section 7-89 of the Connecticut General Statutes. Letters are being sent to all New London County Constables in an effort to notify them of their eligibility and to recruit their participation in the service of capiases within the region, if the same should become necessary.

Judge Leuba said the Branch has a variety of resources available to ensure that court business continues without delay in spite of the administrative changes within the sheriff’s department.

"There is absolutely no delay in the work or function of the court that has resulted from the decision of the New London County High Sheriff to disband the local capias unit," Chief Court Administrator Judge Robert C. Leuba announced today. "I am committed to ensuring that individuals in violation of court orders are made to answer for their failure to live up to their obligations, regardless of any administrative decisions within the sheriff’s office."

The Branch was notified last month that the High Sheriff of New London County had dissolved a unit formed within his office to coordinate service of capiases in the towns comprising the New London Judicial District.
