Statement of Senior Associate Justice David M. Borden
In
my capacity as Senior Associate Justice of the Supreme Court,
exercising the powers of Chief Justice pursuant to Section 51-3
of the Connecticut General Statutes, I have determined that the
Judicial Branch should seek to intervene in support of the
action being brought by Senior Justice William J. Sullivan to
quash the subpoena issued by the Chairpersons of the
Legislature’s Judiciary Committee. Intervention is appropriate
and necessary to safeguard the important principle of the
separation of powers. Steven D. Ecker of Cowdery, Ecker &
Murphy has been retained to represent the interests of the
Judicial Branch in this matter.
As I
have previously indicated to the Chairpersons of the Judiciary
Committee, I will appear voluntarily before the Committee on
Tuesday, June 27, 2006, and welcome the opportunity to respond
fully and fairly to all appropriate inquiries.
