In Re: Claims of Racial Disparity in Death Penalty Cases

A hearing on a motion to dismiss in the above referenced case is scheduled to begin Thursday, Dec. 13, 2007, at 10 a.m. before Superior Court Judge Stanley T. Fuger Jr. The case also is scheduled for Friday, Dec. 14 at 10 a.m.

Judge Fuger will conduct the hearing from the gymnasium at Northern Correctional Institution in Somers. All of the participating inmates from death row are expected to attend the hearing. Currently, those inmates are: Robert Breton, Sedrick Cobb, Robert Courchesne, Russell Peeler, Richard Reynolds, Eduardo Santiago and Daniel Webb.

Members of the media and public may watch the hearing via a live video feed into Courtroom A, at the GA 19 Courthouse, located at 20 Park St., Rockville. Members of the news media and the public will not be allowed into Northern Correctional Institution to watch the proceedings.

The motion to dismiss was filed on behalf of the Commissioner of Correction. Copies of the motion and other documents in the case are available for review at the court clerk’s office at GA 19.

The consolidated habeas matter stems from an order from the Connecticut Supreme Court that all racial disparity claims in death penalty cases should be presented in a consolidated habeas corpus proceeding.

For information regarding arrangements at GA 19, please contact Rhonda Stearley-Hebert, manager of communications for the Judicial Branch, at 860-757-2270. For information regarding the setup at Northern Correctional Institution, please contact Brian Garnett, director of external affairs, Department of Correction, at 860-692-7780.
